We work exclusively on the basis of the German Freight Forwarders' Standard Terms and Conditions 2017 (ADSp 2017). Note: Section 23 of the ADSp 2017 deviates from the law with regard to the maximum liability figure for any damage to goods (Section 431 of the German Commercial Code) by limiting the liability for multimodal transportation, including sea transport and if the damage site is unknown, to 2 SDR/kg and otherwise limiting the standard liability of 8.33 SDR/kg in addition to EUR 1.25 million per claim or EUR 2.5 million per damage event, but at least 2 SDR/kg.
German law also applies. The place of jurisdiction and place of fulfilment is Duisburg-Ruhrort, insofar as the conditions in the applicable law permit this kind of arrangement for the place of jurisdiction.
